Jacques Lambert Ltd. – General Terms and Conditions of Sale

Article 1 – Definitions
For the purposes of these Terms and Conditions, the following definitions apply:

  • Consumer: A natural person acting for purposes wholly or mainly outside their trade, business, craft, or profession.

  • Contract: The contract for the purchase and sale of Goods between us and you.

  • Goods: The sweaters and related products listed on our website.

  • Order: Your offer to purchase Goods from us.

  • Right to Cancel: Your right to cancel the Contract under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

  • We/Us/Our: Jacques Lambert Ltd., a company registered in England and Wales (Company No. 12345678).

  • You/Your: The Consumer who places an Order with us.

  • Working Day: Any day other than a Saturday, Sunday, or public holiday in England.

Article 2 – Applicability
These Terms and Conditions apply to every offer made by us and to every Contract concluded between us and you. By placing an Order, you confirm that you are a Consumer and that you accept these Terms and Conditions.

These Terms and Conditions, along with our Privacy Policy and Returns Policy, constitute the entire agreement between us. They are available on our website at all times and will be provided to you with your Order confirmation.

Article 3 – The Offer and Product Information
Each product listing on our website constitutes an invitation to treat. The images, specifications, and colours of Goods are as accurate as possible but may vary slightly. All Goods are subject to availability. We reserve the right to correct any errors or inaccuracies at any time without prior notice.

Article 4 – Formation of the Contract
The Contract is formed only when we dispatch the Goods to you and send you a dispatch confirmation email. We reserve the right to refuse any Order at our discretion. You will be notified and refunded in full if we do so.

Article 5 – Right to Cancel (Your "Cooling-Off" Period)
You have the right to cancel the Contract for any reason within 14 days of the day you receive the Goods (the "Cooling-Off Period").

To exercise your Right to Cancel, you must inform us of your decision before the 14-day period has expired. You can do so by a clear statement (e.g., an email to returns@jacqueslambert.co.uk). You may use the model cancellation form on our website, but it is not obligatory.

You must return the Goods to us without undue delay and in any event within 14 days of informing us of your cancellation. You must bear the direct cost of returning the Goods. The Goods must be returned unused, in their original condition and packaging, with all tags attached.

We will refund you the price paid for the Goods (excluding the original delivery cost) within 14 days from the day we receive the Goods back or evidence that you have sent them back. We may deduct an amount if the value of the Goods has been reduced by your handling beyond what is necessary to establish the nature and functioning of the Goods.

Article 6 – Exceptions to the Right to Cancel
The Right to Cancel does not apply to:

  • Goods made to your specification or clearly personalised.

  • Goods which are unsealed for health protection or hygiene reasons (e.g., underwear, socks) once the seal is broken.

Article 7 – Price and Payment
The price of the Goods will be as stated on our website at the time of your Order, inclusive of UK VAT. We reserve the right to change prices before we accept your Order.

Delivery charges will be clearly displayed during checkout. Standard delivery to UK addresses is free.

Payment must be made in full at the time of placing the Order via our secure payment gateway.

Article 8 – Delivery
We aim to deliver within 3-5 Working Days to UK addresses. Delivery times are estimates only and are not guaranteed. Time is not of the essence for delivery.

The risk in the Goods passes to you upon delivery. Ownership passes to you once we have received payment in full.

If we fail to deliver, our liability is limited to the costs of return and replacement or a refund of the price paid.

Article 9 – Conformity and Warranty (Your Legal Rights)
We warrant that the Goods will correspond with their description, be of satisfactory quality, and be fit for purpose. Your legal rights under the Consumer Rights Act 2015 are not affected by these Terms.

If you believe any Goods are faulty, not as described, or otherwise not in conformity with the Contract, please contact us immediately at support@jacqueslambert.co.uk. You have a legal right to a repair, replacement, price reduction, or refund, depending on the circumstances. Please see our Returns Policy for full details.

Article 10 – Our Liability
We are liable to you for foreseeable loss and damage caused by us. We are not liable for:

  • Loss or damage that was not foreseeable at the time the Contract was formed.

  • Loss or damage caused by your failure to follow care instructions.

  • Business losses.

Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, fraud, or any other liability which cannot be limited or excluded by law.

Article 11 – Events Outside Our Control
We are not liable for any failure or delay in performing our obligations due to events beyond our reasonable control, including strikes, lockouts, supply chain failures, and natural disasters.

Article 12 – Complaints and Disputes
We aim to resolve any complaints amicably and promptly. Please contact us at support@jacqueslambert.co.uk in the first instance.

If we cannot resolve a dispute, you may refer it to the UK’s Alternative Dispute Resolution (ADR) service, which we are obliged to inform you of. Alternatively, you may pursue your legal rights in the courts of England and Wales.

Article 13 – Governing Law and Jurisdiction
These Terms and Conditions, and any dispute or claim arising from them, shall be governed by and construed in accordance with the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction.
